LEGAL AND COPYRIGHT RESOURCES FOR CREATIVES
February 17, 2020
This helpful resource was brought to our attention by Hailey, a student in one of Stacey Granados summer digital arts camps. She found it on the Statutes of Limitations website.
"The law provides an incentive for people to create new works by giving them ownership of their creations for a specific period of time. Having the exclusive right over their works means that the creator will be the only one to make money off of their work. However,..."
This article talks about art and websites, the differences between a  copyright and a trademark and provides links to many additional resources about copyright, fair use, and specific links for artists & photographers, writers, and musicians.

ARCHIVING A SOCIALLY ENGAGED PRACTICE
"In fifty years, there will be a major retrospective on Socially Engaged Art. How will this work be contextualized? What, if any, visual, tactile ephemera is there to show? What about documentation? Related programming? Re-creation of works?
Artists: What can you save to show? What are your responsibilities in preserving your legacy?
Institutions: How are you preserving the memory of this work? What are your responsibilities, whether from the curatorial side or education/public programs?"
The extensive information in this link was generated at a workshop held with California College of the Arts' Social Practice MFA/MFA

CODE OF BEST PRACTICES IN FAIR USE FOR THE VISUAL ARTS
The College Art Association has published this comprehensive manual, which provides visual-arts professionals with a set of principles addressing best practices in the fair use of copyrighted materials. It describes how fair use can be invoked and implemented when using copyrighted materials in scholarship, teaching, museums, archives, and in the creation of art.

For a shorter overview, check out the editorial "Art Copyright, Explained" by Isaac Kaplan on Artsy.net.

LEGAL ADVICE, EDUCATION AND OTHER ASSISTANCE FOR ARTISTS
"Over the past several decades, lawyers and other advocates have formed organizations across the country to support visual, literary, and performing artists. Volunteer Lawyers for the Arts, formed in 1969 and based in New York City, is the oldest of these. VLA and many other organizations provide legal advice, mediation, education, and other services to artists and nonprofit organizations on a pro bono basis or at reduced fees." This page lists contains links to many of these organizations across the country.
